The software, hardware design and end-user documentation (“Materials”) of the Corelsa Remote Long Sound Analysis tool (“Tool”) is made available by the Universiteit Antwerpen to the research community through a GNU General Public License v3 (“GPL v3”), CERN Open Hardware License – Strongly Reciprocal version 2 (“CERN-OHL-S”), and Creative Commons Attribution–Share Alike 3.0 Unported license ("CC-BY-SA”) respectively (“Licenses”).
The user acknowledges and accepts that only the Materials will be made available, not the Tool itself. By using the Materials, the user accepts the terms and conditions of these Licenses and the provisions of this Disclaimer.
The user accepts that the Materials are experimental in nature and may have hazardous properties and are provided by the Universiteit Antwerpen “AS IS”. The Materials are provided by the Universiteit Antwerpen with no warranties of any kind, express or implied, including but not limited to any warranty of merchantability, title or fitness for a particular use or that the use of the Materials will not infringe any patent, copyright, trademark or other proprietary rights.
To avoid any misunderstandings, the user acknowledges and accepts and is fully aware of the fact that the Tool, for which only the Materials will be made available, is not a medical device, has not been tested, is not clinically validated and there are no warranties of any kind with regard to the clinical use of the Tool or with regard to a possible clinical added value taking into account that the Tool has not yet been tested in a validated clinical study.
The user shall be solely responsible for the use to which it puts the Materials and/or any derivatives (“Derivatives”) and/or any tools developed by the user based on the “Materials” within the scope of what is allowed under the Licenses and shall be responsible for using the Materials and/or Derivatives and/or tools in accordance with all applicable laws and regulations.
The user shall be solely responsible for obtaining any licenses, authorizations or any other permits which are required or imposed by any applicable law or regulation. The user agrees to assume all liability for damages, costs, losses of any kind, which may arise from the use of the Materials and/or any Derivatives and/or any tools based on the Materials within the scope of what is allowed under the Licenses.
The Universiteit Antwerpen cannot be held liable for any indirect or consequential damages, including but not limited to loss of reputation, customers, revenues, profits or production. The Universiteit Antwerpen shall not be liable towards the user for any other damage, claim or demand made by the user due to or arising from the use of the Materials and/or Derivatives and/or tools by the user.
